Terms of Use.

1. Operator and Acceptance

RootPlus is operated by Hanna Pixels d.o.o. (“Hanna Pixels”, “RootPlus”, “we”, “us”, or “our”). These Terms of Use and End User Licence Agreement (“Terms”) govern your use of the RootPlus mobile application, websites, APIs, navigation services and related functionality (collectively, the “Service”).

By downloading, installing, accessing, creating an account for or using RootPlus, you agree to these Terms. If you do not agree, do not use the Service.

Nothing in these Terms excludes, restricts or waives rights, remedies, obligations or liability that cannot lawfully be excluded or restricted under applicable Croatian law, European Union law or other mandatory consumer-protection legislation.

2. The RootPlus Service

RootPlus is a route-planning, navigation and driving-assistance service.

Depending on the app version, platform, subscription, country, device, available datasets and third-party services, RootPlus may offer:

• route planning and navigation;
• car and truck vehicle profiles;
• vehicle-restriction-aware routing;
• fuel, electricity and travel-cost estimates;
• toll and vignette information;
• parking information;
• traffic and road information;
• speed and enforcement warnings where lawful;
• Dashcam functionality;
• saving a planned route for guidance without internet;
• Bluetooth audio;
• Android Auto;
• Apple CarPlay;
• waypoints and other location-based functionality.

RootPlus is under active development. Not every feature is available on every platform, vehicle, device, subscription tier or geographic area.

RootPlus covers Europe only. Routes, costs and warnings outside Europe are not provided.

3. Eligibility

You may use RootPlus only where you are legally capable of entering into these Terms.

If applicable law requires parental, guardian or other lawful authorisation, you may use the Service only with that authorisation.

Use of RootPlus while operating a vehicle is permitted only by a person legally authorised and competent to operate that vehicle and only in accordance with applicable traffic and road-safety laws.

4. Safety Comes First

RootPlus does not replace road signs, traffic lights, police or emergency instructions, official closures, physical restrictions, local law, professional-driver obligations, weather awareness or the driver's independent judgement.

The driver remains responsible for the safe and lawful operation of the vehicle at all times.

Do not interact with RootPlus in a way that distracts you from driving.

5. No Guarantee of Route Accuracy or Suitability

Routes and navigation instructions may be incorrect, incomplete, unavailable, delayed, outdated or unsuitable.

A suggested route may fail to reflect road closures, construction, private roads, access controls, emergency restrictions, border restrictions, low-emission zones, seasonal restrictions, ferry availability, weather conditions, newly changed traffic rules or other circumstances.

RootPlus does not guarantee that a route is the fastest, shortest, cheapest, safest, most efficient, legally available or physically passable route.

Actual road conditions and official instructions always take precedence.

6. Vehicle and Truck Routing

Vehicle-aware routing depends on the accuracy of vehicle information entered by the user.

You are responsible for entering, verifying and maintaining information including:

• vehicle category;
• height;
• width;
• length;
• weight;
• axle information;
• trailer configuration;
• hazardous-goods status;
• emissions classification;
• fuel or propulsion type;
• other legally relevant vehicle restrictions.

Incorrect or incomplete vehicle information may cause an unsuitable route.

Even where correct information is entered, underlying road databases may contain errors or omissions.

Professional drivers and transport operators remain responsible for independently verifying legal and physical route suitability.

7. Tolls, Vignettes and Road Charges

RootPlus may display or estimate tolls, vignettes, congestion charges, road-user charges, tunnel fees, bridge fees, ferry charges, low-emission-zone fees or similar travel costs.

Such information is provided for planning purposes only and may be incomplete or inaccurate.

You are responsible for purchasing and maintaining all required vignettes, toll products, permits, road-user accounts and other authorisations.

To the maximum extent permitted by law, RootPlus is not responsible for fines, penalties, surcharges or other consequences resulting from non-payment or incorrect use of such products.

8. Parking Information

Parking locations, zones, prices, restrictions, hours, availability and payment information may be incomplete, outdated, delayed or incorrect.

RootPlus does not guarantee that parking is available or permitted, that a displayed tariff or zone is correct, or that any payment obligation has been satisfied.

Official signs, local regulations and parking operators take precedence.

9. Travel Cost Estimates

Fuel, electricity, toll, vignette, parking and total trip-cost calculations are estimates only.

Actual costs may differ because of driving style, traffic, weather, route changes, charging losses, vehicle condition, exchange rates, tariffs and third-party pricing.

10. Traffic and Road Information

Traffic and road-condition information may originate from independent providers and may be incomplete, inaccurate or delayed.

RootPlus does not guarantee the accuracy of congestion, incident, closure or alternative-route information.

11. Speed Limits, Cameras and Enforcement Warnings

Where legally available, RootPlus may display speed limits, fixed or mobile camera information, average-speed zones or other enforcement-related warnings.

Such information may be inaccurate, outdated, incomplete or unavailable.

The absence of a warning does not mean that enforcement is absent.

The driver must obey official posted speed limits and applicable law regardless of RootPlus information.

RootPlus users can report cameras, police checks, accidents, road works and other road events, and can confirm or dispute existing reports. Reports must be truthful, made in good faith and lawful where you are. Do not submit reports that are false, abusive, or that identify or concern other people.

By submitting a report you grant Hanna Pixels d.o.o. a worldwide, non-exclusive, royalty-free, perpetual licence to store, process and combine the report with other data, to show it to other RootPlus users and to use it to provide and improve RootPlus. Reports are shown without your name. Hanna Pixels d.o.o. may review, merge, hide or delete reports.

12. Local Legality of Driving-Assistance Features

Laws governing camera databases, radar warnings, enforcement-location information, Dashcam recording and similar functionality vary by jurisdiction and may change.

RootPlus may disable, alter or restrict features by country or region.

You remain responsible for ensuring that your use of a feature is lawful.

13. Maps, GPS and Device Accuracy

Maps and geographic information may contain errors, omissions or outdated information.

GPS accuracy may be affected by tunnels, buildings, mountains, weather, satellite availability, device hardware, operating-system behaviour, battery-saving settings, radio interference or network conditions.

To the maximum extent permitted by law, RootPlus is not responsible for inaccurate navigation resulting from inaccurate, delayed or unavailable device-location information.

14. Connectivity and Offline Use

Certain RootPlus functions require internet connectivity.

Loss of connectivity can result in unavailable routing, failed recalculation, missing warnings, unavailable traffic information or reduced functionality.

Saved routes and locally stored information may become outdated.

15. Android Auto, Apple CarPlay, Bluetooth and Vehicle Systems

Compatibility with Android Auto, Apple CarPlay, Bluetooth, mobile operating systems and vehicle infotainment systems depends on third-party platforms, device models, operating-system versions, vehicle manufacturers, regional availability and third-party approvals.

Hanna Pixels d.o.o. does not manufacture or control those platforms and does not guarantee continuous compatibility, approval, availability or error-free operation.

16. Dashcam

Dashcam functionality is optional.

You are solely responsible for ensuring that recording, storing, sharing or publishing footage is lawful in the jurisdiction where it occurs.

Dashcam footage may contain roads, people, registration plates, private property, workplaces, border facilities, police activity or other regulated content.

Where legally required, you are responsible for consent, notices and compliance with privacy, surveillance and data-protection law.

RootPlus does not guarantee that Dashcam recording will start, continue or save successfully.

Recordings may be lost due to insufficient storage, operating-system restrictions, application termination, device failure, overheating, permission changes or other circumstances.

17. RootPlus Is Not an Emergency Service

In an emergency, use the official emergency services available in the relevant jurisdiction.

18. Third-Party Providers and Data

RootPlus may depend on independent third-party services for mapping, routing, traffic, geocoding, tolls, parking, application distribution, payments, hosting, operating-system functionality or vehicle integration.

Such providers may include Google, Apple and others.

Third-party services can change functionality, pricing, API behaviour, usage limits, geographic coverage or availability without RootPlus controlling those changes.

To the maximum extent permitted by law, Hanna Pixels d.o.o. is not responsible for independent third-party acts, omissions, outages or data errors.

Camera, fuel-station, charging-point and average-speed data comes partly from OpenStreetMap (© OpenStreetMap contributors, Open Database License 1.0) and from official sources such as the Spanish Dirección General de Tráfico. Sources, licences and how to obtain the OpenStreetMap data are described at rootplus.eu/map-data.html.

19. Accounts and Credentials

You agree to provide accurate account information and safeguard login credentials.

You must not impersonate another person, access another account without permission, bypass account restrictions or misuse RootPlus authentication systems.

20. Free, Trial and Paid Access

RootPlus may offer Free, Trial and Paid access.

Features may vary by plan, vehicle type, country, platform or version.

Under the current RootPlus model, expiry of a trial may return the account to a limited Free mode rather than automatically charging the user, unless a purchase screen expressly states otherwise and the user affirmatively authorises an auto-renewing or paid subscription.

Free mode may exclude functionality that creates material third-party API costs or other premium features.

We may reasonably modify future plan contents, subject to mandatory consumer rights and already purchased entitlements.

21. Subscriptions, Billing and Cancellation

Purchases made through Google Play, Apple App Store or another authorised marketplace are also subject to that marketplace's terms and billing rules.

Before purchase, the purchase interface will display material terms including price, billing period and renewal conditions where relevant.

If a subscription is auto-renewing, it may renew until cancelled under the applicable store rules.

Users are responsible for managing subscriptions through the platform used to purchase them.

We reserve the right to change subscription prices for future billing periods where permitted by law and applicable store rules, with notice where required.

22. Refunds and Statutory Rights

Refund eligibility depends on applicable law, marketplace rules, the nature of the purchase and the circumstances of the request.

Where Google Play or Apple processed the purchase, refund requests may need to be submitted through that platform.

Nothing in these Terms limits any mandatory statutory right to a refund, remedy, withdrawal, conformity, repair, replacement or price reduction where applicable.

23. Beta, Preview and Internal Testing Versions

Development, beta, TestFlight, Google Play internal-testing, closed-testing or other pre-release builds may contain defects, crashes, incorrect calculations, missing functionality, compatibility problems, data loss or security issues and are intended primarily for evaluation and testing.

To the maximum extent permitted by law, use of pre-release versions is at your own risk.

We may modify, reset or discontinue a test build or environment at any time.

24. Updates and Compatibility

RootPlus may require updates for security, legal compliance, compatibility, third-party API changes or continued service operation.

Older versions may stop functioning or become unsupported.

Nothing in this section limits mandatory obligations to provide updates, including security updates, where required by applicable consumer law.

25. Licence to Use RootPlus

Subject to these Terms, Hanna Pixels d.o.o. grants you a limited, personal, revocable, non-exclusive, non-sublicensable and non-transferable licence to use RootPlus for its intended purpose on devices you own or control, subject to applicable platform rules.

RootPlus is licensed, not sold.

No ownership of software, databases, designs, trademarks, algorithms or other intellectual property is transferred to you.

26. Intellectual Property

RootPlus software, source code, branding, logos, user interface, original databases, documentation, graphics and other original content are owned by Hanna Pixels d.o.o. or used under licence.

Third-party maps, datasets, software, trademarks and services remain the property of their respective owners.

27. Acceptable Use and Prohibited Conduct

You must not use RootPlus to:

• violate applicable law or another person's rights;
• attack, overload or disrupt RootPlus infrastructure;
• bypass security, subscription or entitlement restrictions;
• introduce malware;
• probe vulnerabilities without authorisation;
• scrape or systematically extract protected data;
• operate unauthorised automated high-volume requests;
• resell RootPlus or protected data without permission;
• reverse engineer RootPlus except where applicable law expressly permits it;
• copy protected RootPlus material to create a competing service.

We may apply reasonable technical limits, rate limits and anti-abuse measures to protect RootPlus, users, providers and infrastructure.

28. Feedback

If you voluntarily provide bug reports, suggestions, ideas or other feedback about RootPlus, you grant Hanna Pixels d.o.o., to the extent permitted by law, a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify and incorporate that feedback into RootPlus and related products without compensation or attribution.

29. Service Availability, Modification and Discontinuation

RootPlus may be unavailable because of maintenance, updates, capacity limits, internet failures, provider outages, security incidents, legal restrictions or other circumstances.

We do not guarantee uninterrupted or error-free operation.

We may modify, replace, restrict or discontinue functionality where reasonably necessary for technical, security, legal, provider, app-store or commercial reasons, subject to mandatory rights of paying consumers.

Discontinuation of RootPlus

We may discontinue RootPlus as a whole, or in a country or on a platform, for technical, legal, provider or commercial reasons, including where continued operation is no longer economically viable.

We will announce a discontinuation at least 30 days before it takes effect, in the app and by email to the address of your RootPlus account where we have one. The announcement states the date on which the Service ends (the “end date”).

From the announcement, no new subscriptions are sold. Where Google Play or Apple allows us to, we stop the automatic renewal of existing subscriptions; where a store does not allow it, the announcement explains how to cancel the renewal in that store. Paid access continues until the end date.

If you are a consumer and paid in advance for a period that continues after the end date, you are entitled to a refund of the unused part, in proportion to the remaining days. Refunds are made through Google Play or Apple where they allow it; otherwise Hanna Pixels d.o.o. refunds you directly on a request sent to privacy@rootplus.eu within 12 months of the end date.

After the end date the app may stop working, because routes, prices, warnings and accounts are provided by our servers. We delete account data within 30 days after the end date, except records we must keep by law (see the Privacy Policy).

Beyond the refund above and any other mandatory consumer right, no compensation is owed for a discontinuation announced and carried out in accordance with this section.

30. Suspension and Termination

We may suspend, restrict or terminate access where reasonably necessary because of a material breach of these Terms, suspected fraud, unlawful use, security risk, abuse, expired entitlement or legal requirement.

Users may stop using RootPlus at any time and may end this agreement by deleting their account. Subscriptions billed by Google Play or Apple are cancelled in that store (see section 21).

We may end this agreement with all users by discontinuing RootPlus as described in section 29.

31. Privacy

Personal-data processing is governed by the RootPlus Privacy Policy .

The Privacy Policy and these Terms serve different purposes and should be read together.

32. Disclaimer of Warranties

To the maximum extent permitted by applicable law, RootPlus is provided on an “as is” and “as available” basis.

We do not warrant that the Service will always be:

• available;
• uninterrupted;
• error-free;
• accurate;
• complete;
• current;
• secure;
• compatible with every device;
• suitable for every route, vehicle, business, professional activity or purpose.

We do not warrant the accuracy, availability or completeness of independent third-party information.

Nothing in this section excludes mandatory statutory guarantees, digital-content conformity rights or other rights that cannot lawfully be excluded.

33. Limitation of Liability

To the maximum extent permitted by applicable law, Hanna Pixels d.o.o. will not be liable for indirect, incidental, consequential, special or purely economic loss resulting from use of or inability to use RootPlus where such liability may lawfully be excluded.

This may include, where legally permitted:

• route delays;
• additional fuel or electricity consumption;
• additional tolls;
• parking charges;
• towing costs;
• missed appointments;
• missed flights or ferries;
• loss of profits;
• loss of business;
• loss of data;
• third-party outages;
• inaccurate road information;
• reliance on estimated travel costs.

To the maximum extent permitted by law, Hanna Pixels d.o.o. is not responsible for fines, penalties or regulatory consequences resulting from failure to comply with traffic laws, parking rules, toll or vignette obligations, environmental-zone requirements, vehicle restrictions, professional-driver requirements, Dashcam law or other local requirements.

34. Additional Terms for Business and Professional Users

If you use RootPlus wholly or mainly for trade, business, transport, logistics or professional purposes, then, to the maximum extent permitted by applicable law, Hanna Pixels d.o.o.'s aggregate liability arising out of or relating to the Service will not exceed the total amount you paid directly for the relevant RootPlus service during the twelve months preceding the event giving rise to the claim.

For business and professional users, RootPlus must not be treated as a substitute for legally required professional route planning, fleet compliance, transport documentation, driver-compliance systems or regulatory verification.

35. Indemnity for Unlawful or Abusive Business Use

To the extent permitted by law, a business or professional user agrees to indemnify Hanna Pixels d.o.o. against third-party claims and reasonable direct costs caused by that user's deliberate unlawful use of RootPlus, deliberate misuse of the Service or material breach of these Terms.

This clause does not apply to consumers where such an obligation would be prohibited or unfair under mandatory consumer law.

36. Force Majeure and Events Beyond Our Control

To the extent permitted by law, Hanna Pixels d.o.o. is not responsible for delay or failure caused by events beyond its reasonable control, including:

• natural disasters;
• severe weather;
• war;
• civil disturbance;
• government action;
• telecommunications failure;
• widespread internet or power failure;
• cyberattacks;
• third-party platform outages;
• strikes;
• comparable events.

37. Apple App Store-Specific Terms

Where RootPlus is downloaded through Apple's App Store, these Terms are between you and Hanna Pixels d.o.o., not Apple.

Hanna Pixels d.o.o., not Apple, is responsible for RootPlus and its content, subject to these Terms and applicable law.

Your licence to use the iOS application is limited to a non-transferable licence to use RootPlus on Apple-branded products that you own or control and as permitted by the applicable Apple Media Services Terms and Family Sharing or similar rules.

Apple has no obligation to provide maintenance or support services for RootPlus.

You must comply with applicable third-party terms when using RootPlus, including mobile network, connectivity, vehicle-platform and app-store terms.

You represent that you are not prohibited from using the application under applicable export-control or sanctions laws.

Apple and its subsidiaries are third-party beneficiaries of the Apple-specific provisions of these Terms and may enforce those provisions against you to the extent provided by Apple's applicable terms.

38. Mandatory Consumer and Digital-Content Rights

If you are a consumer, nothing in these Terms deprives you of mandatory rights available under applicable law, including rights relating to:

• conformity of digital content or digital services;
• remedies for non-conformity;
• legally required updates or security updates;
• unfair contract terms;
• mandatory consumer-protection remedies.

If a disclaimer, limitation, governing-law clause, jurisdiction clause or other provision conflicts with a mandatory consumer right, the mandatory right prevails to the extent of that conflict.

39. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Croatia, without prejudice to mandatory consumer-protection rules that may apply under the law of a consumer's country of habitual residence.

Where legally permitted, disputes are subject to the competent courts of Croatia.

Where mandatory consumer law grants a consumer the right to bring or defend proceedings elsewhere, that mandatory right remains unaffected.

40. Changes to These Terms

We may update these Terms to reflect new functionality, security requirements, legal obligations, third-party provider changes, app-store requirements or changes to the Service.

The current version will be published on the RootPlus website.

Where applicable law requires advance notice or affirmative acceptance of a material change, we will provide it.

41. General Legal Provisions

Severability

If any provision is found invalid, unlawful or unenforceable, it will be limited or interpreted to the minimum extent necessary and the remaining provisions will continue in effect.

No waiver

Failure by Hanna Pixels d.o.o. to enforce a provision does not waive that provision or the right to enforce it later.

Assignment

You may not transfer your contractual rights or obligations under these Terms except where applicable law gives you a non-waivable right to do so.

Hanna Pixels d.o.o. may transfer these Terms in connection with a merger, restructuring, transfer of RootPlus, sale of relevant business assets or similar transaction, subject to applicable law.

Entire agreement

These Terms, the RootPlus Privacy Policy and any specific purchase terms presented at checkout constitute the agreement governing your use of RootPlus.

Where specific purchase or feature terms conflict with these Terms, the more specific terms govern that feature to the extent of the conflict, subject to mandatory law.

No professional advice

RootPlus does not provide legal, tax, insurance, engineering, mechanical, transport-compliance or other professional advice.

Where professional verification is required, obtain advice from an appropriately qualified person or competent authority.
